The District Consumer Disputes Redressal Forum (DCDRF), Madurai has directed a Madurai-based used car dealer to pay Rs 3.95 lakh to a woman customer, including the sale price for selling a defective car.
The petitioner, N Sudha of Madurai had purchased the car, a hatchback from Best Motors private limited in Kappalur. The car was sold to the firm by the owner, after being used for three years. After negotiations, Sudha bought the car at Rs 3.4 lakh in 2013.
However, within a few days of purchasing the car, the vehicle developed a technical snag and broke down abruptly near the Thirumangalam toll gate. Sudha had called the dealer and they towed the vehicle back to the firm.
Meanwhile, months passed and they failed to either return the vehicle or the sale amount of Rs 3.4 lakh after which she filed a complaint with the forum seeking compensation of Rs 10 lakh apart from directions to return the original sale amount.
The dealer never responded to the petition or filed a counter before the forum.
After perusing the submissions made, the forum concluded that the dealer had sold the car with defects beyond repair. The forum directed the dealer to return the amount of Rs 3.4 lakh to the complainant and also a sum of Rs 55,000 for the mental agony caused to the customer.
