Setback to govt; High court quashes FIRs against ED

Kochi: In a major setback to the government, the Kerala High court on Friday quashed the two FIRs registered by the Crime Branch against the Enforcement Directorate officials over charges of forcing the accused to take the name of Chief Minister in connection with the gold smuggling case.

Observing that the procedures were not followed, the High Court upheld the request of the ED.

The HC also noted that the findings of the Crime Branch that the ED officials forced the gold smuggling accused, when in ED custody, to take the name of Chief Minister Pinarayi Vijayan, should be examined by the special court.

The statements and the evidences collected by the Crime Branch should be submitted in sealed envelope at the principal sessions court handling financial crimes in Ernakulam, the high court further instructed.
